The UN demands the immediate release of Sergei Tikhanovsky and compensation. This is the conclusion of the International Organization's Working Group on Arbitrary Detention. She has examined the complaint filed in defense of Sergei Tikhanovsky, reports the "Viasna" human rights center, which is deprived of registration.

The Working Group on Arbitrary Detention is a legal mechanism established by the United Nations Human Rights Council. The Committee is composed of five experts, selected on the basis of a competition among recognized legal experts and authorized to deal with individual complaints. Decisions are taken at working group meetings under the so-called contested procedure, where the state has the opportunity to challenge the facts of the person who filed the request. And the authorities' response is taken into account at the time of the decision.

In the case of Sergei Tikhanovsky, Belarus participated in such a procedure: on May 14, 2021, the Working Group sent a communication concerning Tikhanovsky to the government of Belarus. Belarusian authorities reacted on June 24 this year.

Accordingly, the Working Group came to the following conclusions: Siarhei Tikhanovsky's detention was arbitrary, the Belarusian authorities should take urgent measures for his immediate release, pay compensation for the violation of his rights and investigate the circumstances of his arbitrary detention. They also say that Tikhanovsky's trial shouldn't be, but, nonetheless, the trials are still ongoing.

The Working Group considers that, having regard to all the circumstances of the case, the appropriate remedy would be the immediate release of Tikhanovsky and the right to compensation and other remedies under international law. In the current context of the international COVID-19 pandemic and the threat it represents in places of detention, the Working Group calls on the government to take urgent measures to ensure the immediate release of Tikhanovsky ”, we can read in the conclusion, which was adopted by UN experts on September 6 and 10, 2021. unrelated reasons.

The task force demands that the Belarusian authorities disseminate their opinion "through all available channels and as widely as possible".
